Terms of Service

These Terms of Service ("Terms") govern your access to and use of Excelendar (the "Service"), provided by GCalTools ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Acceptance of Terms​

By accessing or using Excelendar, you confirm that:

  • You are at least 18 years of age or the age of majority in your jurisdiction
  • You have the authority to enter into this agreement
  • You agree to comply with these Terms and all applicable laws

2. Use of the Service​

  • You may use Excelendar only in accordance with these Terms and applicable laws.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • We may suspend or terminate your access if you misuse the Service.
  • You may not use the Service to violate any laws, infringe intellectual property rights, or harm others.

3. Subscription & Payment​

  • Excelendar is offered as a subscription service. Fees, billing cycles, and cancellation terms are described at the time of purchase.
  • Payment Processing: All payments are processed exclusively through Microsoft's commerce platform. Microsoft acts as the merchant of record for all transactions.
  • Microsoft Terms: Your purchase is also subject to Microsoft's Commercial Marketplace Terms.
  • You are responsible for any taxes or charges applicable to your subscription.

4. Free Trial​

We offer a free trial:

  • The trial period and terms will be clearly displayed at sign-up
  • You may cancel at any time during the trial without charge
  • If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged

5. Cancellation & Refunds​

  • Cancellation: You may cancel your subscription at any time through your Microsoft account. Cancellation will take effect at the end of your current billing period.
  • Refunds: Refund requests are subject to Microsoft's refund policies. Generally, you may request a refund within a limited time after purchase (typically 24 hours for subscriptions).
  • We do not process refunds directly. All refund requests must be submitted through Microsoft.

6. Data Access​

  • Outlook Calendar: Excelendar requests permission to access your Outlook Calendar data to provide import/export functionality.
  • Permissions: We only request the minimum necessary permissions to perform the services you request.
  • Data Processing: We process your calendar data only as necessary to complete your export requests. We do not store your calendar events beyond what is required for the import/export operations.

7. Intellectual Property​

  • Excelendar and all related content are owned by GCalTools.
  • You may not copy, modify, distribute, or reverse engineer the Service except as permitted under these Terms or applicable law.

8. Privacy​

  • Your use of the Service is also governed by our Privacy Policy.
  • We only access or process data as required to provide the Service.

9. Service Availability​

  • The Service is provided "as is" and "as available."
  • We do not guarantee uninterrupted or error-free access to the Service.
  • We may modify, suspend, or discontinue the Service at any time, with or without notice.
  • We will make reasonable efforts to provide advance notice of planned maintenance or service changes.

10. Disclaimers & Limitation of Liability​

  • Warranties: The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Limitation of Liability: To the fullest extent allowed by law, GCalTools is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or business interruption.
  • Maximum Liability: Our total liability to you for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination​

  • By You: You may cancel your subscription at any time through your Microsoft account.
  • By Us: We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or for any other valid business reason.
  • Effect of Termination: Upon termination, your right to use the Service will immediately cease. You may export your data before termination.

12. Changes to These Terms​

  • We may update these Terms from time to time. Changes will be effective when posted to this page.
  • We will make reasonable efforts to notify you of material changes (e.g., by email or in-app notification).
  • Continued use of the Service after changes are posted means you accept the new Terms.

13. Governing Law & Jurisdiction​

  • These Terms are governed by the laws of France, without regard to conflict of law principles.
  • Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.

14. Entire Agreement​

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and GCalTools concerning the Service.
